My name is Abhay Vaishnav, and I have a concern. About 15 years ago, my elder grandfather's son and his wife left him. Then, around 5 years ago, they got his property transferred into their names, verbally assuring that they would take care of him. However, since then, my grandfather has developed a serious illness like cancer, and they have not been providing him with proper care or support.
Now, what steps should we take moving forward?
The mode of transfer of property needs to be understood before opining. Since your grandfather is ill, a case should immediately be filed for the fraud and breach they have committed and civil litigation may help you get back the property to its original state, i.e., in your grandfather’s name. By that time you may also get his will registered so that the property doesn’t go to any undeserving person.
Well, on the face of it this looks like your grandfather has a strong case and the present laws suggest that elderly people are to be maintained by their children. Therefore it is advised that you provide all the relevant information to the office m; as it is pertinent to decide any future course of action.
