how can i get my share when my brother is not cooperating us (me & my mother) (Hindu -Nair) for a property dividing after my father's death in 1999, also he is staying in jharkhand for more than 20yrs and no support to my mother.we have 36 cents of land and a house in kerala where my mother and my family staying together. i and my mother tried many times to contact him and he refuses to come for a share as he is married and lives in his wife house whenever he comes kerala. how can we get him for a partition as i cannot go for a bank loan or any other loans for my family.so i want to approach court so that equal partition can be done. please help me with your advice.i am not financialy sound for filling a case.i have younger brother too but mother has given her 17cents land to him and he has legaly seperated from this property. thanks please advice.
hallo... you can move to the civil court and file a partition suit. Since you belong to Hindu community the share of your father will be devolved his legal heirs including his mother if she alive. So you can file a case of partition suit at the earliest.
