Property issue with mother refusing me to give me my share

07-Sep-2023 (In Property Law)
I'm nitin from ghaziabd. I was living in kanpur city before may 2019 with my family. We belong to undivided hindu family. After my fathers intastate death in april 2009 there were 5 persons left in my family as class1 heirs, my mother, two married sisters and two brothers. Our house was fathers self aquired property. My mother and sister transferred title to mother's name using fake noc on my behalf without my consent and knowledge , so i haven't raised any objection for mutation of property. After mutaion she posted a paper ad against me for iviction from the property, and i was totaly unaware of all that. Then on 22may2019 she asked me to come at registrar office to sign the papers of sale and take my share. When i signed those papers, she refused to give me my share. After that i got information about all those fake mutation and iviction ad. Now i want to know is there any way to get my legal share being a class 1 heir. Please help me in this situation. With regards Nitin.

hello

as per your legal issue you may require to challenge the sale deed in court which is bit lengthy process.
And the documents you have signed that needs to prove it was not in your notice .

Pls file a partition suit, and claim your 1/5th share in this property. Seek a stay order of status quo, so that the nature of property is not changed. This case will have to be filed in the Kanpur district court. Engage a local lawyer having experience of handing civil/property cases
