the query posted by you is silent on various aspects which are necessary to be able to advise you properly, as in whether the property is in joint name with your husband and his brother, whether your your brother in law too contributed towards the constitution of the house, whether the land on which the building is constructed is self acquired or ancestral property, how long has your brother in law been living there, etc. however, your husband may consider sending his brother a legal notice stating the illegality committed by him. if no response or corrective action is taken by your brother in law, your husband may file appropriate proceedings before the civil court. criminal proceedings may also be considered based on facts of the case.
