Property is not divided yet brother started construction on it

I want to stop the illegal construction which is undivided among for brothers after mother and father passed away.myself and my family staying in Bangalore and my property is in Patna.how I can take action to stop the construction which is started by my one of brothers.
Dear Sir/Madam, you have to file civil suit for partition if not partitioned between you and your brother. If yes, you have to file civil suit for Permanent Injunction against your brother for not to construction on the said suit schedule property of yours. You have to file the civil suit is only jurisdiction Patna civil court as per u/s 15 of the Code of Civil Procedure.
