A land in the name of elder son' s wife. House build by me after retirement and my three other sons . After mutual settlement she transfer the power of attorney in my name for the portion of my & my three sons, resultantly I transfer the portion to my son's. She goes to court and said that she transfer the power of Attorney for taking care of property. As we have no proof of building the home (1989) they win the case . My Question is can we move to high court so that we can stay in the house. Is Thier any law to protect our right to leave in th house as the house was build by the money received on retirement. At the time of purchase of property the money was provided my but no prof.
Yes you can file appeal and seek injunction from dispossession. The judgment and decree need to be examined with case file so that proper appeal could be filed challenging the lower court judgment and decree.
