Property fraud by the Property Dealer

In June 2018 a property dealer shown us a property to invest and we given 7 lakh rupees advance for a 37 lakh property. After 1 year no communication from his side after many calls and msgs no response. We requested them to return our money. After so many reminders he give us cheque of 7 lakh but told us not to put in bank. We also checked in bank and in bank insufficient amound is there. Every time we asked he told to give him some time. Now cheque validity of 3 months also expired, he stopped receiving calls . Please help what we should do as it is hard earned money.

Dear Sir, You may file a summary Law suit against property dealer. This will be decided in your favour and a decree with interest will be passed by the court. My office may file lawsuit if you interested. Thanks and Regards.

hello client as i can read the things which you have mentioned over hear is a fraud played by a dealer on you in the name of the property in the form of advance taken for booking a peoperty on his own advice. in the present stuation it seems you people have been fooled by tht dealer. to recover tht amont you are required to take help from court in the form of filling a recovery suit along with a criminal case to recover your hard earned money.

Often times clients are lathargic and slow in their response time, your is the perfect case wherein you ruined your case by not taking appropriate action on time. There are two cases that are attracted against this property dealer ONE make a police complaint against the property dealer and file an FIR against him, prima facie section 420,406 of IPC are attracted in the police complaint mention the name, address, gst number if any or CIN if any of the property dealer also mention and enclose the copy of the cheque that he gave you to discharge his debt which has been dishonoured. SECOND case of cheque bounce is also attracted against the property dealer, but in cheque bounce you have to send a legal notice within 30 days of the dishonour of cheque and then file a case. This time limit is mandatory for a cheque bounce case but sadly it appears to have been delayed.
