Property Division disputes regarding how to partition the property

15-Mar-2023 (In Property Law)
What is the criteria of dividing the property by meets and bounds. If there is property which is made of two portions and has single story house. The property can be divided in a few different ways. There are four claimants. One wants to merge both the portions and divided floor wise which will be constructed. The other feels that all four can not work together and there will be a lot of disputes going forward. . He wants two to have one portion and other two to have other portion. The third one with whom the father was living wants bigger portion.

Hello i have perused your query. If the property is ancestral or self acquired in nature and the owner dies intestate or without any will then the shares will be divided equally among the legal heirs.
Thereafter the partition can take place by metes and bounds.
The right way to proceed under the circumstances described by you is to file for a partition suit in a civil court of competent jurisdiction in order to crystallise shares of everyone in the property.
