Property distribution dispute how to resolve
19-Aug-2023 (In Property Law)
My father and Uncle bought a residential land in 1 around 1992. My Uncle want front side any how . And now he has captured front side. Now could you please tell me if we can make an equal distribution.
Yes as there are joint owners i.e. your uncle and your father you can file for a partition suit before the Hon'ble court and the court can divide the property accordingly and there should be no dispute once the court orders have come
The best thing of course will be if you can sign a family agreement by marking the boundary in such a way that both are happy. If that is not possible you will have no choice but to file a suit for partition by metes and bounds.
