Property distribution between children of two wifes
26-Aug-2023 (In Property Law)
My parents divorced when I was 3 years age. I m having name of biological father's name in birth certificate and step father's name in school leaving certificate and Aadhar card and voter ID card and other documents. At now I m 45 years. My father died. Now what is my right in my biological father's property because my biological father remarried and had two sons
From what i can make out if your step fathers name is in your school certificate and Aadhar Card then i assume he has adopted you.
Now if the step father has legally adopted you then your biological parent has relinquished his right as a father and therefore you cannot claim any right of inheritance of propery which belonged to your biological father.
However if that is not the case and you have not been legally adopted then what now matter is your legal parent? Therefore certain documents are to be looked into and your legal parent has to be ascertain and if it is concluded that your biological father is your legal father then yes certainly you can claim a right in his property as a legal heir.
Facts reamain to be ascertained and until you provide me with all the details I can't provide you with an accurate answer.
