Hi Sir,
My father sold 4 acres of land to someone. That is ancestry property. Without our mother and children signature, my father sold. We have done the ancestry property case. We lost the case in Taluq and District level as they have given the reason for education purpose his father sold the property. But that is wrong and I have done my education by taking an education loan. I have proof of all the documents. Can you please guide me if I go for 2nd appeal is there any chance to prove there is no necessity to sell our property?
Yes , as per the law the Ansaerteral property should not be sold without the prior approval of the members as such irrespective of the things you can go for Appeal eaisly no issues but the thing is such we need to prove to court stating with all the facts so that the court will reconsider and and file can appeal through specific performance in immovable land but you will get your land subject to proper argunments
We need to file Regular Second Appeal under section 100 of the CPC. 2nd Appeal must be filed along with IA to produce evidence as the Ancestral property was sold with out consent of dependents. You can contact me for for the purpose of filing the above RSA.
