Property Dispute after Father Death

My Father has 3 Sons - father made a will to make all three sons owner of the property - After the death of the father one of the son wants his share and is ready to move out of the agreement - how to process this. Do we need to pay any stamp duty registration etc ? Hindu Family.

The Son who wants his share can sell/Gift his share to the remaining 2 Sons or either of them and the said agreement has to be registered with concerned sub- registrar office by paying appropriate registration charges and stamp duty as per the nature of document.

This is my response to you: 1. You need to obtain probate of the will; 2. Once that is obtained all brothers get a share; 3. Then the 3rd brother can sign an release deed and release his share; 4. Consult a local lawyer and take steps.
