property be tranfered to my mothers name

I live in mumbai, a roman catholic, I being the grandaughter, my grandmother passed away in 2005, it was after that i.e my grandmother having 2 children after her passing away the house allottee was my uncle now residing in canada, bt he had given an affidavit stating he has assigned all the rights and interest to his sister i.e my mother and that none of his heirs or assigns shall have any right over the property. Now my question is can the property be tranfered to my mothers name and what documents would be required?

Dear Madam, The ownership of the property needs to be checked from all the Title Deeds of the property in order to advise you regarding this issue. It is further necessary to check as to what all documents have changed regarding ownership of the property on the basis of the affidavit given by Uncle. Regards, Adv. Shrikant Bagade

Hello there! If you want to get property transferred to your mother. Ask your uncle to execute gift deed in your mothers name. It is cheaper way than any others. Your mom will become absolute owner. Only affidavit will not sufficient. For execution of gift deed you will have to submit all documents relating to property and documents reflecting how your uncle got it. Plz let me know in case you want to go for the same. I will tell you the procedure in detail
