Procedure to transfer rights regarding land belongs to father.

Actually my father had 4 male and 3female children, now my father passed away nearly 4yesrs,, but their rights is not transferred to any one, totally 5acre arecaanut plant and but we part the agricultural land and 3acre farm land,,, both land is not allocated to us,,, so now how can we finalise this case,, one of my brother is not allow to finalise this issue,, so how can I easily solved the problem,,, due to this I missed good opportunity during the days and also facing problems in many years ,, please assist how can I solve this easily without going court,, please suggest me

If your siblings are not ready to partition the property then you arrange for a family sitting where elders of the family are present and try to resolve the matter. If not then issue legal notice and try to resolve through advocate by having a sitting with them. If even this fails then you will have to file case before court and resolve.

As per hindu partion act if your father expire after 2005 and without any will or any partition among your brother and sisters . fisrt give the application for servey of land and get map of 11 e. then you may go for suit for partion and injunctions and make party to all members with your father. Sisters and brothers so go ahead if you neec more info you may call given number
