Procedure to transfer deceased father's property to mother

04-Jul-2023 (In Property Law)
Hi, My Father has gone to the heavenly abode. But we have a home in co-op housing society and we want to transfer the property in my mother's name. We have submitted all the relevant docs to the chairman and secretary of the society. But now he is saying that the relevant papers required for transferring property in my Mother's name are lost. So what is the legal procedure to transfer the property in my Mother's name? My Father had left a will to transfer the property in my Mother's name.

Take the receipt of papers handed over to the society and also ensure that society files FIR with police for having lost the original papers of the property. You fill all the required documents and attach will and these two documents and apply. The society has to give you the membership as per will or nominee.

Hi,

You can file an application in the CGHS office along with relevant documents and the office bearers will have to transfer the membership in your mothers name within 30 days of application, if they deny they will have to forward the application in Registrar Cooperative society office and they will do the needful.

Thanks
