Procedure to purchase a resale flat which is under construction

Sir, I am going to purchase a resale flat in kolkata which is under construction. The said flat owner has received allotment letter from builder as confirmation.no agreement to sale executed yet.based on demand letter generated owner paid amounts to builder for which receipts held. Now I want to purchaSe the property by transfer of ownership .builder also agreed to do so by paying some fees..plz inform how I can proceed for the same. Thanks.
First of all hire the services of an advocate/ law firm to check the paper and guide you through and one more thing you will be registering sale deed with the builder, which means the original buyer has not registered the property in his name and you are the first owner of the flat so legally it’s not a resale... my advice to you are
1. You should have all the paper checked
2. You should have your own advocate until the registration is done
3. Hire anyone but do hire services it’s not that ki we want you to hire us.

Yes, you can do that with proper procedures. You can go for that with registry of that property or made an agreement for sale with builders and also you have to take no objections certificate from the right owner. For further assistance contact me.

you can easily pay the amount to the flat owner and talk to the builder to issue another allotment letter in favour of you. otherwise you can even go ahead with the builder and the flat owner, if they are trust worthy. if you have some other query, it would be better to have a face to face interaction.

The new purchaser will have to agree to enter into agreement with the new owner after the agreement with the first intending owner is formally cancelled. The new purchaser will have to pay the amount to the builder and not the person who surrenders the flat. The first person has not become the owner.
