Procedure to own diseased father's property

Sir, A flat in kolkata jointly in name of my father and me. Now my father was expired. Should I need any legal procedure for entire ownership. Regards.

If it is a co-operative society flat then you would need permission of the cooperative society before mutation and rectification of records with the local municipal corporation.

However if it is a ownership flat then you may simply get it done without any permission from anyone else. visit the orporation office with the death certificate. And you job should be done.

No legal procedure is required, if you the only son of your deceased father then the entire 50% share is vested upon you by operation of law. but let me know the following things:-
1. whether you have any brother or sister? or
2. son/daughter of any predeceased brother or sister?
3. Is your mother alive?
4. Has your father died intestate?
5. Has your father more than one wife during his lifetime?

In the above situations you will not get the entire share of your father

You have right to get only 50% share from joint property and rest portion of share(your father's share 50%) shall be divided equally among the legal heirs and successors. You have right to get 100% share from your deceased father's property, if your father not left any legal heir, except you.
