Procedure to file suit against the fraud committed by seller

we had buyed a property in 1975 and the property is in our possesion and we had done the sale deed , registration but unfortunately on property card and 7/12 could not get the name and from whom we had bought property has again sold to another person, we have to file suites for the same. kindly suggest what would be the procedure for filing suites and property valuation would be max 1 Crore , what would be the court fees for mumbai high court.

Dear Querist, whose name now appears on the property card?? file a suit and seek injunction from the hon'ble Bombay high Court. the court fees for for claim upto Rs 1 crore would be Rs 1,33,230/- and may vary as your claim increases.

You will have to file a suit claiming your rights in the property. Court fees will be around Rs.8,00,000/-. Try getting your name on the property card with the help of your registered sale deed. . You need to take quick action on this.

Firstly do not vacate the premises under any circumstances. Secondly, need to immediately file case in Court and seek interim relief, so that the other party does not sell the land further. We can then take other necessary action as is available under law.
