Procedure to claim share in father in law's ancestral property

My father in law's father expired when he was 7 years. His father and father's brother (uncle) were doing business together.Also they were having some ancestral property. My father in law's uncle made a partition deed when he was 11 years.In the partition deed he made four lists of properties List 1 for father in law's uncle. List 2 for my father in law List 3 for my father in law;s Grand mother List 4 to be enjoyed by my father in law and his uncle My father in laws uncle expired with out any children. My father in law was having 2 sisters and one aunt ( sister of his father also expired)) who was having 6 children .Since they were not able to amicably divide property in List 1 and List 2. they went to court. Court ordered them to divide the property equally. So my father in law got a share of this property ( 1/9th share of the property in List 1 and List2. Kindly let me whether this is self acquired property or ancestral property of my father in law. Hindu

What your father in law got is his share in the ancestral property . The court only made a distribution of the property among the legal heirs. Thus it is very clear that your father in law inherited a portion of the ancestral property. It is not a self acquired property.

As your father-in-law acquired his share of the ancestral property through a court order, the property becomes his exclusive share, and shall not have any ancestral character attached to it. Your father-in-law can deal with it in any manner he likes.
