Procedure to claim possession of property given to others temporarily

Hello, My father took a house for my moms mom my granny means he paid 35 to 40 k for the house so my granny my mama and my masi use to stay there and after feW years my mama got expired and before his death he told my dad I will return you the house amount but his death took place accidently. So my granny went to village and at that time my moms sister got married and she started staying there still my dad didnt say anything looking at my mom and told let it be for our children marriage. But then the place got demolished and they got flat at chembur 1rk now its almost 10 years my masi is staying and now for our marriage we need it so will we get it back.

This is my response to you:
1. Technically speaking, your father has only given money;
2. If the property is in your father's name then only you can claim possession;
3. You can send a legal notice for eviction;
4. If they do not respond then you can file a suit for eviction.

Yes you can get back. If your father has all documents stating that your father is owner of that property.

you can have it back subject to you have all proper and valid documents pertaining to the said purchase by your father. further, its almost 10 years don't delay much if you really want to take action against the said trespass coz after some more years they can even claim legal rights on the same by virtue of adverse possession since you were sleeping over your rights since years and years.
