Procedure to claim father's share of property from grand uncle

Dear Sir/Mam, my concern is that my dad have a huge property. but its divided to all in 5 brothers. but my grand uncle he not giving property part to my father. so we decide to file case against our grand uncle.so please guide me how many days taking for stay order by court after file the case?. & how much money is expend on that stay order process? Property is based in village and as well as in a city also. village property is in yadgir,Karnataka & the city property is in Ambernath,Mumbai.

First of all you need to show that how does your father gain the title of the property whether it is by succession or that it is an ancestral property or whatever. Only when you are able to show any of these things, the court will give a stay order on any third party transaction of the said properties

Collect all documents and if it is ancestral property thefees n file suit for partition, declaration and Injunction. Fees can b negotiable subject to severity of case. Without going through documents not so easy to come on conclusion. It will not b good to fire in Air.
