Procedure for succession of properties of deceased husband

03-May-2023 (In Property Law)
My friend's husband expired two years before. He owned a house (flat in an apartment) in Mumbai and it is registered in his name. At present, my friend is working in Bangalore. She wants to know the legal procedures involved (certificates, other documentations) required to transfer the property in her name and their two children (one is major and another is minor). The family belongs to Muslim Religion.

Was there a nomination in your friends name ? If not then she simply has to inform the society that she desires her name on the share certificate and if the society wishes they will ask her for the requisite documentation to be given by her which she can get through her lawyer

If your friend's Husband had not made a Will, then your friends has to get Legal Heirship Certificate + Succession Certificate in order to get Properties of her Husband. Moreover, to get flat transferred on her name from the Society which was on the name of her Deceased Husband, procedure is bit different. However, these two certificates will be required to be submitted before the Society too.
