Possession of Property Based on Ownership Title and Illegal Commercial

We are plot owners. A 1997 eviction suit failed for lacking lease docs. In 2007, we filed a fresh suit for possession based on Ownership Title. Lower courts dismissed it citing Res Judicata, but High Court ADMITTED our Second Appeal. Occupant illegally rented plot for a hotel and collects rent. Can we file an Interim Application in High Court to deposit this rent in court? How to expedite final hearing via Praecipe?

I can help. Since the Second Appeal is admitted, you may file an Interim Application seeking a direction to deposit the rent collected by the occupant in Court. You can also file a Praecipe requesting an early hearing by showing the long pendency and ongoing financial loss.

yes you need to make an interim application asking for yeh rent to be deposited in high court and asking for other beneficial relief according to your suit, to expedite your final hearing you need to complete all the pleading and getting the lower court files and if there is any marathi documents add typed translated copy and typed copy for unclear pages then it will be listed every week on final hearing board, but if you file interim application the matter won't be taken for final hearing
