Possession of a flat without signing apartment deed

Dear sir,
I have purchase flat in Phase I and paid full value of Flat but builder verbally informed that he will give possession only after signing of apartment deed. It is a complex of 24 buildings and only phase I is completed. but No water no proper road and no committed amenities ( club house is )ready. All flat owner wants to form Co-op society instead of Apartment Condominium . so I want possession without signing Apartment deed. Can I get possession without signing apartment deed. Kinldy suggest

If Completion Certificate got by builder from local authority.Then you can get possession of flat.and you can also file consumer complaint in consumer forum for possession with complete amenities.

This is my response to you:
1. Why would you want possession of the same?
2. Has the CC and OC come?
3. Occupying the flat without a OC is wrong and the municipal authority may evict you;
4. Regarding the Deed, the society members can decide that the builder cannot decide whether it will be a condominium;
5. Once the conveyance is made in favour of the society then the society can obtain its registration number etc.;
6. Consult a local lawyer and take steps.
