Person claiming the site my house stands on was sold to him earlier
10-Apr-2023 (In Property Law)
I have purchased a constructed house in 2005. I have been living in it peacefully after all the document verification for 15 years. Now, in 2020 a man claiming to be the legal heir of X has come forward claiming the property. He has another sale deed which was made between his mother X, and the father of my vendor from 1992. They are claiming that our vendor has illegally sold the property of his father by changing the Katha number to us. This property was acquired by my vendor's father as ancestral partition. Are we in trouble? How strong would his case be? We have paid the property taxes for the last 15 years and have the EC in our name. Also, there is a court order from 2000 where the father of my vendor has given the property to him after a dispute.
Looking into the facts which you have mentioned, at the outset it seems that you have a good title over the property which can be seldomly questioned, if you are suspecting any legal action against you by that party or if you are sustaining any problem by them , you may have to move forward to court of law for appropriate remedy of injunction and declaration if at all required.
