patta not bifurcated. Can i get land without 2nd person sign

10gunta land was partioned b/w father family members (not ancestors,it was purchased by my father &uncles) each getting 2 gunta & each have their updated RTC and patta. In this 1 family(2 brother's with joint ownership was given in 1 deed & both there name is reflected in RTC but only 1st brother name in patta book.I want to purchase 1 gunta land from 2nd brother as he needs money& want to sell his portion land. How can I purchase this,so 1st brother would not create issue in future.
