Partition of 30 percent plot with a house among 3 siblings

There is 30 cent plot with an old house (facing to main road) in my fathers name..my father expired 10 year back intestate..my mother passed away last yeae.....we are 3 siblings....2 brothers and 1 sister(me)... my elder brother is staying in that house..he is not willing for partition of that house . My younger brother want that house too...but elder brother dont like to sell that home to younger bro nor he is giving share amount to us ...what I can do in this..I am willing to give my share on that home to my younger brother...any use of it.???...if 2/3 share goes to my younger brother can he claim that house? ( HE is ready to give cash share to elder but elder is adamanat) we dont wish to sell that home as its our va
The only option is to file a suit for partition. You or your brother can file the suit.The proceedings during the suit offers opportunities for settling the matter through mediation or adalat. Expenses would be nominal if the property is shown as in joint possession.
