Parking problem in the society what to do

As me the Secretary of Society, should we be allowing Parking to an occupant who is been staying around 20 years in a society. The occupant is not a member neither associate member and also not a nominee, however his father was a original member and got expired few years back. As per the Bye Laws, we (the Managing committee) have asked the occupant to become a member first only after which the parking will be alloted. So is it necessary for the occupant to become member first or can we allote the parking space directly without him being a member.

If occupant is the only legal heir, you can make him a member on the basis of his application and `letter of admn. if property is in mumbai or on basis of his application and death cert. of his father and thereafter once he is admitted as member, parking can be allotted. you have not mentioned reason as to why said step has not been taken till date if his father had expired few years back. if any other legal heirs are existing and/or creating dispute then you must insist for a court order for the same if letter of admn cannot be obtained by the present occupant who was staying alongwith his father and presumably a member of the society.

if even if father was not admitted as a member of the society then facts are to be looked into in details.
