Parents gifted property but not giving papers to me what can be done

A property was given to me as a gift deed from my parents at the eve of my marriage.But the documents were kept by them ever since.Later I got divorced and had a girl child .Then on I have been living with my parents.Both of them have been evilish,verbally and mentally abusing myself and my child along with denying personal freedom.Since we were their dependents there was no other option.Now that my daughter(23) got a job in Bangalore, against all odds we moved here and she is taking care of me now. She wish to go for higher studies and for that I need those documents to take an education loan .But they have no intention of giving it and blackmailing me that she should marry someone they say instead of studying further.Can I transfer it to my daughter's name without the original documents?If not,What should I do to get the documents immediately?Can I file a complaint in the police station?if there is no other way,Should I take the case to family court or district court?

Family court has no jurisdiction on this matter. If you want to approach the court you can file a case before the civil court where the property situates. Or else send a lawyer notice to the parties to return the documents.
