Paid booking amount seller cancelled the sale and not returning amount

Hi I am raj kishor yadav . i had signed agreement to buy a flat in noida supper tech ecovillege 1 that was resale flat. as for the agreement we need to pay 10% of agreement value. i paid this money to seller by cross cheque, now seller not ready to sell there property nor return my money these all process done by the agent now agent also telling you to pay few more money. i am unable find sutailbe way to get my money back. Please suggest me good way. i am ready to pay 50000/- for return my money. but my condition is, i will pay the fee on same day when will get my money back. thanks
There seems to be deficiency in service on the part of the builders and therefore you can prefer a Complaint before the Consumer Forum as well as before the newly established Real Estate Authority under the Real Estate Act. However you ll have to elaborate as to where the Property is situated, where the agreement has been entered and so on.
