Paid 40% of the amount to book a flat, builder not doing work

I booked a flat in Dec2014 with Umang Realtech in their sec 78 MB2 project in Gurgaon. I have alredy paid 40% of amount. As per the agreement I will get Rs5/psft post dec 2018. Builder has no intention either to resume the projet neither to refund the paid money. Could you provide any remedy as per Haryana Rera or otherwise. Also can I only take any legal action post the date of delivery by the builder buyer agreement. Thanks.
Hi, you can file a case with the jurisdictional consumer forum for getting your grievance addressed. Alternatively, a complaint before the State RERA Authority can also be filed.
If it can be factually substantiated that the builder's intent to complete the project nor handover the property is lacking or his commitments may not be fulfilled for a long time from now, the case can be initiated right away and need not wait till agreed date of possession.
