Pagadi property in mumbai..,..................

Please disregard the category of issue. My father has a house in pagadi system since 1980 in mumbai He along with my mother purchased another ownership flat in 2011 Further..me along with my brother are considering to purchase a flat in our joint name. Will this affect our claim on the pagadi house...because we have another ownership flat

Under the Pagdi system in Mumbai, tenancy rights are governed by the Maharashtra Rent Control Act, 1999. Merely owning another ownership flat does not automatically disqualify your or your family's claim over the Pagdi property. However, succession to tenancy rights generally favors the legal heir who was residing with the tenant at the time of their death. If none of you were residing there or if the landlord challenges succession, ownership of other properties may be used as a factor in court, but it's not solely decisive. Ensure proper documentation of continuous residence and utility bills to support your claim when required.
