Ownership transfer of flat after demise of unmarried intestate owners

My brother, say X, unfortunately died in '23. He died unmarried and intestate. He owned a flat in Mumbai. It was redeveloped in '01 and was owned by him and our unmarried sister, say Y, who died in '07. The society recently found that Y was incorrectly removed from the share certificate. Do we now need 2 succession certificates/LOAs?

Yes, two succession/loa would be required for both your brother and your unmarried sister. Two certificates are required as they are two different individuals who expired at different points of time. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Hi, for each deceased person, u will have to apply for separate Letters of Administration, irrespective of whether they jointly owned a property, since Letters of Administration is issued for a deceased person and not for any property.
