Owner not transferring property after father's death

I live in pagdi system house which was in name of my deceased father, the owner after my dad death is not transferring it to my mother and since 10 years he is forcing tenants to either sell to him or go to court , it is a 1 room house I will be moving out of this home to a bigger house , I want to sell this property but his quote is way too low as per land rates in chembur. As of now I am living in that house but within 1 year I will shift to an apartment and this room may be left empty. What do you suggest go to court or sell him at throwaway price .FYI , I am well off and am in no hurry.

Hi,
In the absence of documents in favour of your mother, the owner is claiming the property. The pagadi system is lost its value and rule.As regarding the value of property only court can adjudicate for whis he is ready you can workout a resonable valuation as per the land rates applicable in Chembur. You will have the right till you are in possession of the house. Once you move out of the house, then you will at the land lord mercy and terms.You have to settle the ossue before leaving the house.

It is his duty to isssue rent receipt in name of legal heir of deceased. R u paying rent regularly ...in whose name recepts r issued..he can not compel to sell him..however if der is any tenancy agreement den need to c terms of d same.secondly never kept room unoccupied.. dis can b strong ground for him for eviction.
