Other party started construction, case already pending in court

05-Sep-2023 (In Property Law)
To state the facts 1) The property was equally divided as per the "naksha" during the draft. This was done long ago, however the "naksha" clearly divides it into equal propertion. 2) The person who is already residing in his side of the property, illegally started construction on our side of the property. 3) Upon hearing this we got the "naksha" taken about by the municpal authority in the region and later filed a case in the district court. The court gave a stay order on the construction 4) After almost a year of court visits nothing has changed and we keep visiting. Now suddenly they have started construction again. Is this not contempt of court. Please help me understand what action can be taken to help secure our property

The construction is definitely contempt of court and the contempt proceedings can be initiated against the same. Therefore you can also get the construction demolished as well. Therefore you need to file the appropriate application in the court,Please contact for further details thanks.

Dear querist,

if the person has violated the Order of the District court then the same amounts to contempt in that case you can file a petition before the court stating the violations of the persons and pray for immediate relief.
