Notice to Builder and My Husband

I had booked a flat in chembur with my husband, we both paid equal amount but he was doing fraud and removing my name from property. Now I want to send a legal notice to builder and my husband to recover my amount because builder is saying that he will disburse the amount in the same account(husband's account) from which he received. my husband transferred my amount to my his account and then to builder's account. Already Domestic Violence case is filed in Nagpur. I need a budget lawyer for recovery case.
This is my response to you:
1. You can first send a legal notice;
2. If you have filed a DV case then maybe you also filed a divorce case?
3. You can also seek 50% claim if you have filed divorce case;
4. You can also initiate a suit in the civil court;
5. Consult a local lawyer and take steps.

You can't recover from your husband but you can claim legal title in flat.If you have proof of transfer of funds to your husband's account.You can file civil suit against husband for declaration of joint title of flat. And you can also demand of possession of flat for residential purpose under Domestic violence Act.
