Notice from anadi court dadar for illegal occupancy in new property

The builder has not yet obtained Occupancy certificate and has given possession, but someone through RTI filled a court case in anadi court in dadar against the flat owner and builder. What is the impact for the flat owner ? Does the flat owner names gets in litigation in future ? Can the flat owner get a passport ?
This is my response to you:
1. If the OC has not come then possession cannot be given out;
2. There could be litigation against the builder;
3. The person who has filed a case has no locus standi against the flat owner;
4. The flat owner must ideally not obtain passport of that address since it is in dispute;
5. Consult a local lawyer and take steps.

Third person has not having any right to sue.Owner can claim against builder for occupancy certificate. And passport can be obtained from appropriate authority. Under which Law and section third person filed case is not clear.Therefore it is not possible to advise clearly.
