Not getting the possession of the Flat by the builders

Sir, as per the clause No.6 (b) mentioned in registered agreement of sale entered between undersigned & XRBIA builder as on 12.02.2013 (copy enclosed), we are suppose to get the possession of our Flat No. A14 / 108 on 31.12.2015 or maximum 31.03.2016. The same was not done due to delayed construction and major civil issues cropped up in the flat, After this, I am repeatedly following up with the builder through email, phone calls and personal visit on 27.06.2017 begging for the possession of my flat after getting fixed all major civil problems & compensation for delayed possession. The builder was very reluctant towards our genuine request. Since, it is difficult to get the peaceful possession or refund of our hard earned money invested in the project with interest. Please advise course of action.
You have a very good case. You need file a case before Consumer Forum for refund of money with interest and also for compensation for delay possession, harrsssament. You can avail other remedy before civil court as well.
what i understand from your query is that builder is not giving you possession of your flat but am not able to understand the reason behind. In normal course, you can lodge compliant and file case against the builder in the Court as well as you can also file case in consumer court. But to understand your matter you need to take my appointment and meet me.
As per clause no. 6 (b) mentioned in registered agreement u are suppose to get possession on12/02/2013.agreement is registered agreement u send him notice by lawyer. he is not giving u the possession of the property and also not ready to refund the money from 3-4 years.
