NOC from legal heir for transfer of property

My friend who is a senior citizen has a flat in joint name with his wife who has since expired. Both their children are US citizens and are keen to get the flat ownership changed to their father's name . What is the process to be followed ? Does it require that both of them to be present here while providing the consent through an affidavit or can the affidavit be duly attested by the Consular / Embassy in US ? Please advice.

Hello, I have seen your query carefully and found that your friend can file a petition in civil court for declaration of the absolute owner of the property after the death of his wife. your friend can made parties to both of his son. Sons who are resident of USA can give a special power of attorney to any family members or any other person on which they trust. The special power of attorney holder can appear and file written statement and give consent to declare your friend as absolute owner of this flat and his sons are not having any interest in the property.
