NOC for share transfer after mother's death

13-Aug-2023 (In Property Law)
Hello, my mother was sole owner of our flat and passed away. I had one sister who was married but not alive. But her husband and two adult sons (above 18 yrs.) are still alive. I have given application to society for name change in share certificate, since I am only inheritor. They are ready to make the change, but asking me to submit one NOC from other legal heirs. So my question who is legal heir(other than me) since my sister is no more. Is it ok if I take the signature only from sister's husband OR her both sons also have to give NOC? Thanks Ravi

Respected sir

You have to take signature of your sister husband and her sons also because they are her legal heirs.

Where is your flat situated?

After getting other details i can guide you properly.

as per law you and your sister both are the legal heir, but as u have mentioned ur sister is already also died therefore society can transfer the said flat in ur name by taking the NOC from both sons of ur sister and also take NOC from the husband of ur sister for safer side If at all demanded by society nn
