NOC for Mortgage Loan in a private redevelopement project

My flat is under construction in a redevelopement project by a private builder in south mumbai. The builder has done our registered agreement last year. The construction is almost 80% done, due to an medical emergency i am opting for a mortage loan. The financer has approved my loan and has demended 3 documents from the builder i.e. allotment letter, no dues letter and noc. My builder has refused to give me noc.
My question is can my builder refuse to give me noc

This is my response to you:
1. Once you clear your dues then only builder can give you an Noc;
2. Since some payment or maintenance charges may be pending that is why the builder may be refusing to giv you an Noc;
3. Although he can give you a letter that dues have been paid till date;
4. Consult a local lawyer and take steps.
