Need basic points for Joint family Separation

27-May-2023 (In Property Law)
My father has 4 siblings 3 elder brother and 1 elder sister. The sister is dead now. My grandfather died without making any will. Now we are planning separation. What are the basic things we need to keep in my mind so that the separation could be fair for all 4 families. The dead sister was married and has 2 kids, married. Do they get any share out of this?? All 4 brothers are into joint business.

Hello sir. I have perused your query. Since your grandfather passed away intestate, each of his lineal descendants will get an equal share in the property. Your grandfather's daughters share will be divided equally between her two children. You can go in for the divison by means of a settlement agreement or a partition. Please let me know if you need any further information.
