Name correction in registered sale deed
13-Dec-2023 (In Property Law)
My son who is settled in USA is planning to apply for US citizenship/US passport and then apply for OCI card. He owns a registered 2BR apartment in Chennai, and in that deed his last name is entered as "sundararajan". Whereas, when he applies for his USA citizenship,he wants to change his last name from Sundararajan to Sundar. His first and middle name will be the same,as in the sale deed. Because of his new identity (USA citizenship)his surname is different from the name in the sale deed, it may create problems if and when he plans to sell that apartment. can you please explain asto how to make the name correction in the registered sale deed,as per his new surname. Secondly, will his new citizenship affect his ownership of his apartment in anyway.
Us citizenship will no way affect the ownership of the flat. when the flat was brought he was called in the name as per the deed and the subsequent name change can be proved with other Documents and rectification of the name in the deed is not necessary.
If you effect any change in the surname you should do it properly. More over sale deed is nothing to do with authenticating the family name or the surname. You need to verify the Government documents like passport or school completion certificate to find out the given name for your son and his surname. If you want alter or delete part of surname then you need to gazette it to effect change.
