My younger brother passed away due to COVID-19, his wife is torturing

25-Oct-2023 (In Property Law)
Dear Sir, I have 2 younger brothers and lost the 2nd brother due to COVID-19 in Sep-2020. He is married for 4 years and having a son aged 3. Within 16 days of his demise, his wife's family started asking for property transfer , we said will do it in a month's time, but they do not have a patience and they are threatening my family with help of rowdies demanding all properties in my father's name to be transferred to her name and sum of 10 lacs INR. My father aged 67 years and not able to tolerate these torture. All the properties of my father are self acquired My questions are: 1) Are we legally liable to transfer the property to her? 2) are we liable to pay compensation ? 3) Can the properties be registered (gift deed) to us (2 brothers)? if so can she challenge in the court? 4) What other options they have for getting property from us legally ?

In this case, Entirely your father choice if it is a self-acquired property! While the law also enables a coparcener to dispose of his share through a will in an undivided property, the claimant might find it difficult to get his share if he is a third party. Similarly, your father can gift his self-acquired property to anyone they chose. And further, give police complaint against who threading your family members. I have a vast practice in that area you can seek my assistance in your matter.
