my wife wants to relinquish her right on a joint property

We hold a joint property in mumbai in which my wife has decided to relinquish her right. What is the procedure to transfer her share to me and what is the stamp duty charges

Stamp Duty in Mumbai (Maharashtra): ₹200 fixed (if transferred to a spouse or blood relative). 1% of the property’s market value (subject to a max of ₹30,000) if transferred to others. A gift deed Stamp Duty in Mumbai (Maharashtra): ₹200 fixed (if gifted to a spouse or blood relative). 3% of the property’s market value if gifted to others.

Your wife can relinquish her right either through a Will, gift deed or a release deed. Stamp duty to be paid on the gift deed/release deed depends on the valuation of the property. Feel free to contact me for seeking any legal advice as regards the same.

She can relinquish her rights in favour of blood relation by executing gift deed with or without consideration. stamp duty and government charges depends on terms of relinquishing. for further assistance you can consult. my office is at fort and ghatkopar.
