My uncle is not provide us an acces to the farming land of grandfather

19-Oct-2023 (In Property Law)
Sir we are having a property division at the time of 2011 between three brother including my father out of three brothers. In that division we mutually agreed to use the farming land for four years by both of my uncle and my father too. But since my grandfather and grandmother are alive at that time all brother agreed to allow them to do farming till they are alive. Now both of grandfather and grandmother are died in 2016 and when my father ask my elder uncle to provide land to us for farming as per division so he denied and he is placing fake bill and asking for money then only he will allow us to access the land. In that verbal fight my father had a high tension and because of that he is met with brain stroke after few days. I have the copy of division what was done at that time. And all the things are written in that copy on stamp paper of Rs 100. Now I want to Move with the legal procedure to get my land back and also want to appeal for the property division as early as possible.

In your case, once partition deed has been made and is duly stamped and registered your father is absolute owner of said part of the land. That, your uncle cannot claim any rights on the said part of the land. If your uncle is not providing access to your part of land despite giving the repetitive reminder, then you can claim it through filing injunction suit against your uncle.
