My in laws expired and my brother-in- law is living with his wife and daughter in the parental house purchased by my father in law.how to proceed for its distribution?
You need to file a suit for partition
Hi. You have to file a suit for partition in the appropriate court seeking partition of the property. You can also file an injunction suit restraining your brother in law from selling or alienating with the property.
You may approach your brother in law seeking your share in the said property and you may be given the money equivalent or physical possession of your share if possible. In case of any resistance you may approach the concerned court through a civil suit for partition
