Mutation for property in Varanasi based on partition suit order Sasara
29-Jan-2023 (In Property Law)
Hello Sir
I have filed a partition suit in Civil court Sasaram for my ancestors and parents property in Sasaram and Varanasi. I have got order from court based on our Family Settlement letter. Now when I want to do the mutation for my property in Varanasi then Tehsildar told me that he require execution letter from court. I contacted they issued order copy but they are not issuing any letter to the name of Tehsildar. Due to that I am unable to do mutation. Please advise.
they should carry out the mutation on the basis of the compromise decree. why one will go for execution, for a compromise decree which is acceptable to all the parties. it is better you file a writ petition in the allahabad high court and seek directions against the tehsildar against his misconceived demand
Hello
If your mutation cannot be done then there are few questions which shall we clear .
Whether you have filed a mutation or not .?
Why the mutation cannot be done only because of report of Tehsildar ?
What is specific when your mutation is not been decided and why delay .? is it only because of government officer ?
Then you should move a representation that means an application for the court of SDM and district magistrate .
if an enquiry or if any result is found from the their side and your work is done then it's very fine and better or else within one week you can challenge your representation in High Court and your work will be done within two weeks..
