If there is no legal separation of your mother with your father your brother can claim in the property but you are required to take initiative little early to save your property. If your mother has remarried and living separately she will not have any claim on your property

Now they will not have any share in the property of your father.

Even the 10 years period can be taken as an indirect will or can reflect will of your father that he never wanted to give anything to your mother.
