Money loaned to brother for property

I had transferred money to my brother to buy a flat in Pune. I was out of country, property was registered on his & his wife's name. I sent him almost 67% of the total flat cost. I was under the impression that I own my share in the flat. Last year I purchased a flat & got some monetary help from brother. Now he says, he'll return the principal amount to me with no interest at all & I have no claim legally on the Pune flat. He also says that the money he gave me last year to buy a property was an part of returning the original principal amount. He is willing to return the remaining principal amount. I'd like to know if I can legally ask him to return my money with some interest and/or ask for share in the Pune flat. Property has appreciated in the last 5 years. I have no legal agreement being made. Only thing I have are the bank statements of sending money to him.

Yes,
you can claim share in flat by filling civil suit in civil court.
You can file suit for declaration as a co owner in that flat.It is in limitation now to file suit for that flat.Therfore you shall have to retain proof of bank record.

This is my response to you:
1. You can first send a legal notice to him;
2. You can also ask for interest;
3. If he refuses you can file a suit in the court;
4. You can ask for a share in the flat, since you have contributed to the purchase value of it;
5. But since you have no agreement in that regard it will be difficult to ask for a share;
6. Definitely you can ask for the money to be returned to you;
7. Consult a local lawyer and take steps.
